I caught up to him in Olav's in Bruma, to find him already paralyzed on mead. Killing him openly in the crowded room wasn't an appealing option. I had a poisoned apple, unused from an earlier quest. I picked his pocket, taking nothing, but leaving the apple. I then left Olav's, returned shortly and approached him to see his health meter rapidly depleting until he was dead. Then I was even able to help myself to what he had on him of value.
